Dlí amháin dúinn, dlí eile dóibh siúd?

Nó b’fhéidir an fotheidil: Clúdach Gorm na Fírinne

Garda won't be tried for crash into pensioner

Irish Independant Saturday December 17th 2005

The garda who was driving a patrol car that struck a pensioner as she waited at a bus stop will not face any criminal proceedings, an inquest has heard.
The Director of Public Prosecutions has decided not to proceed with a criminal prosecution against the female garda who was driving the patrol car that mowed down 74-year-old Mary Seavers in
Dublin on May 22.
Mrs Seavers, from Goatstown in south
Dublin, died from her injuries three weeks later.

Insp Martin McGonnell of Donnybrook garda station told Dublin City Coroner's Court yesterday that, as no proceedings will be taken against the garda, a date for the inquest into Mrs Seavers' death can now be set.
Mrs Seavers' four children were in court to hear that their mother's inquest will open on March 9 next year.

Mrs Seavers had been waiting at a bus shelter when she was struck by the patrol car on the Clonskeagh Road.
A post mortem found she died of acute respiratory distress syndrome due to multi-organ failure caused by head and leg trauma.

The Garda Press Office claimed that the patrol car was not involved in a chase nor was it rushing to an incident when the crash occured.
However witnesses reported at the time that it had its siren on.

Bhí an bangharda sin ag tiomaint ró tapaigh agus an siren ar súil aice. Ní raibh aon emergency ann. D’imigh an carr as smacht ar an cúinne. Sin a tharla.
Tá alán scéalta ann: Tá sé ráite
1) nach raibh an ceadúnas ceart aice a bheith ag tiomaint le siren, nach raibh an cúrsa sin déanta aici.
2) go raibh sí ar cell fón ag an am.

Tá fios na fírinne aici.

Ar dtúis bhí an sceál amuigh go raibh Mary ag dul trasna an bhóthair sin agus bá ise cúis na timpiste.
An scéal deireanach ná go raibh an tarna bangharda ar an bhfón, ach fón an tiománaí a bhí ann……..nach féidir fiosrú níos doimhne a dhéanamh? Ach is dócha nach ndéanann an coiste fiosraithe aon scrúdú ró doimhne ar duine dá gcuid féin, nó má dhéanann coimeádann siad toradh an fhiosrúcháin dóibh féin.

Dá mbeinn i mo thiománaí i dtimpiste mar seo níl aon amhras ach go mbeadh cúiseamh de shaghas éigin, manslaughter, dangerous driving ar a laghad, os mo chomhair. Ach mar a dúirt daoine áirithe ón dtús “Cuirfidh siad moill agus deacrachtaí os comhair muintir Mary go dtí go bhfuil an méad sin ama thart nach mbeidh an fuinneamh acu leanúint leis……”

Ach, tá an locht ar an mbeanghárda sin agus is brónach an lá é agus í in ann is a bheith i bhfolach ón locht faoi éide ghorm.
